Neinstein & Associates announces new partner Duncan Embury

Neinstein & Associates LLP is excited to announce that Duncan Embury has joined the partnership and will be heading our Medical Malpractice Group. Mr. Embury is a leader in the area of medical malpractice, including obstetrical malpractice, surgical malpractice, hospital and nursing errors and catastrophic personal injury claims. Mr. Embury has more than 20 years of experience as a trial and appeal lawyer.

Duncan acts exclusively on behalf of plaintiffs on cases involving all areas of medical negligence including obstetrical negligence, surgical negligence, hospital and nursing errors, medication errors and errors in diagnosis.  Duncan has extensive experience in litigating acquired brain injury cases from all causes including birth injuries, traumatic brain injury, anoxic brain injuries, ischemic and hemorrhagic strokes and brain abscess.

 Mr. Embury’s expertise is well-recognized in the medical malpractice community. In addition to appearing as trial and appeal counsel, on complex cases involving all types of medical negligence, Mr. Embury also acts as co-counsel assisting other lawyers with intricate cases. Mr. Embury appeared as co-counsel on the Club Resorts Ltd. v Van Breda case with Greg Neinstein helping pave the way for Canadian Citizens to sue for catastrophic personal injuries which occurred in a foreign jurisdiction.

Duncan is a regular speaker and presenter in all areas of medical negligence for the Ontario Trial Lawyers Association, the Ontario Bar Association and the Law Society of Upper Canada. Duncan has been voted by his peers as a leading expert in his field in the 2014 Canadian Lexpert Directory ® and has been named as one of Best Lawyers ® in Canada. Duncan is the recipient of the 2010 Lexpert Zenith Award and the 2013 OTLA Distinguished Service Award.
