WEL Partners is a Toronto-based trust and estates litigation boutique practicing exclusively in estate related matters throughout Ontario.

WEL Partners advises estate trustees, trustees, attorneys, guardians and fiduciaries on their duties and obligations arising both at common law and legislatively. It focuses on opinions, dispute resolution, litigation and mediation of estate, trust and related matters, including related issues of undue influence, decisional capacity, fraud, forgery, suspicious circumstances and technical breaches respecting testamentary instruments.

WEL Partners also advises on wills, estates, trusts, gifts, powers of attorney, guardianship, on financial abuse, predatory marriage, elder abuse, end-of-life treatment decisions, medical assistance in dying, and elder law.

We are seeking an associate lawyer to join our team.

Duties and Responsibilities:

• Transitioning primary carriage of active litigation files across varying stages of proceedings, ensuring timely and effective progression of each matter;
• Developing, assessing, and implementing litigation strategies based on detailed analysis of facts, evidence, and applicable law, under Partner supervision;
•  Drafting pleadings, motion materials, affidavits, written submissions, and other legal documents for use in court and tribunal proceedings;
• Preparing for and attending procedural steps including examinations for discovery, motions, mediations, and hearings, as required;
• Transitioning management of all aspects of client communication, including providing legal advice, reporting on case developments, and addressing client-specific objectives and risks;
• Conducting legal research and analysis to support case strategy and advocacy;
• Liaising with opposing counsel, experts, and third parties in the course of advancing litigation matters;
• Preparing detailed file transfer memoranda summarizing factual backgrounds, evidentiary records, legal strategies, and upcoming procedural steps for each assigned matter;
• Conducting structured handover meetings with successor counsel to ensure continuity of representation;
• Providing transitional support on active files, including briefing incoming lawyers on litigation strategy and preparing them for scheduled hearings and procedural milestones; and
• Assisting in minimizing disruption to ongoing proceedings by ensuring continuity of knowledge and reducing duplication of legal work.

Job Requirements:

• Minimum Education:
  • University degree in Law (LL.B or J.D.) from an accredited law school.
  • Membership in good standing with the Law Society of Ontario.
• Minimum Experience:
  • 1-2+ years of direct estate litigation experience
  • Must be a member in good standing with STEP (Society of Trust and Estate Practitioners) and be agreeable to the licensing and membership requirements therefor.
